Court Appeals

KHA Development Managers provide expert evidence, advice and general assistance with any disputes or appeals lodged with the Planning and Environment Court, Building and Development Dispute Resolution Committee or Queensland Civil and Administration Tribunal.

The primary aim of KHA Development Managers’ Appeals service is to settle issues and resolve all matters to the satisfaction of all parties concerned. Where possible this is done through negotiation however, if required, KHA have considerable experience to assist with the Court Appeal process.

Our experience has been gained by working closely with Local Government and the Development industry over many years. This experience extends to the undertaking of due diligence within the Town Planning development application process (IDAS), strategic planning and policy implementation as well as Local Government consultancy contracts.

KHA Development Managers’ Appeals services include:

  • Consideration of the brief, instructions and advice about the Town Planning merits of a development proposal or highest and best land use, having regard for all key issues in dispute.
  • Assistance with the preparation of a notice of appeal and further particulars as required;
  • Participation in “Without Prejudice” discussions and attendance at “Mediation” with the Registrar of the Court to, at times, narrow the issues in dispute, and ultimately negotiate a positive outcome.
  • Participation in the Joint Meeting process and provision of the Joint Statement/s, as required.
  • Provision of a Statement of Evidence and attendance at Conference/s with Counsel, as required.
  • Attendance at the hearing and give evidence, as required.

KHA Development Managers are aware of the importance of maintaining organised and timely responses and take a positive and proactive approach to ensure the merits of a development proposal are fully expressed and understood.

KHA Development Managers have achieved a significant number of successful outcomes in the following areas:

  • Residential developments, including reconfiguration of land, unit and group housing, motels, hostels and high rise apartments at various scales
  • Retail and industrial developments of various scales: and
  • Other matters including environmentally relevant activities, operational works, advertising signage, development contributions and infrastructure charges and compliance issues.
