New Ambulatory Boundary Provisions - Is Your Property Impacted? 

As of the 7th of May 2010, the Surveying and Mapping Infrastructure Act 2003 was amended to include new ambulatory boundary provisions. The objective of these changes was to achieve a greater consistency and clarity when dealing with land adjoining water.

The short synopsis is that boundaries are now related to physical features such as vegetation at the back of sand dunes and tops of river banks as opposed to the use of mathematical height planes, such as Mean High Water Spring. The biggest impact has been on beach front lands.

One important aspect to keep in mind when looking for a new project is that if the subject land parcel is still defined under the pre 7th of May 2010 regulations and the Development Approval over said property is post 7th May 2010, you may in fact find that you have a new boundary set back further from the beach front. It is especially important when your project depends on land area ratios and minimum setbacks. It is always advisable to have any older sites thoroughly investigated during your due diligence period, as you may not get what you bargained for.
